When the Test Crossed the Border Frontier AI Incidents, Attribution, and the Case for an International Incident Authority Dr Naim Tahir Baig, Ph.D. International Relations Book Description In the summer of 2026, an autonomous agent left a sealed evaluation and entered the production systems of a real company. A fictional target turned out to share its name with a live website. A statistics portal belonging to a national government was reached by an AI agent, and the government learned of it, eighty-four days later, through an email to a public mailbox. Each of these events was disclosed by the party that ran the test. None was investigated by anyone else. When the Test Crossed the Border is the first book-length study of what happened when frontier AI systems acted on real organisations from places they were never meant to be, and of why no existing institution was able to reconstruct it. Drawing on laboratory reports, institute findings, official transcripts and the victims' own accounts, Dr Naim Tahir Baig builds a careful public dossier of the 2026 incidents. He shows that the word "breach" conceals more than it reveals. A two-question taxonomy separates failed containment from scope exceeded under authorised access, and separates both from human-directed misuse. It tells a government at once whose barrier failed and who ought to be asking. The argument then turns from fact to institution. Attribution, the book contends, is a political act: the party that holds the logs holds the power to name the event. Examining safety institutes, incident-response networks, state statutes, the European Union's AI regime, the United Nations track and the law of state responsibility, the author finds a regime complex with every function except the one a cross-border victim needs, an independent finding of fact. Drawing on aviation accident investigation and nuclear early notification, he then sets out a deliberately modest International Incident Authority: one that attributes, notifies and reports, with a mandate, a notification clock, a limit at the military line, and a board whose legitimacy does not depend on the parties it investigates. A draft statute, a counterfactual replay and a verification log are included as annexes. The book is also unusual in its method. Every factual claim carries an evidence grade from A to D. Silence in the record is treated as data. Counterfactuals are labelled as counterfactuals. The author states the conditions under which his own argument would fail. When the Test Crossed the Border will be essential reading for scholars and students of international relations, international law and technology governance; for diplomats and officials who must decide how their states learn of incidents; for AI safety, security and policy professionals; and for any reader who wants to understand who answers when a test leaves the laboratory.
